The applicable general conditions of sale are those of SAS ACLP.
The customer must have read these Terms and Conditions before sending his order. By confirming its order, the customer accepts these conditions in their entirety.
General conditions of sale
These terms and conditions of sale are concluded on the one hand by SAS ACLP whose registered office is at 78 Alfred Sisley Street, 76620 Le Havre, registered in the Commercial Register and the companies of Le Havre under number 495 263 972, VAT No: FR54495263972, hereinafter referred to as "ACLP", and on the other hand by any natural or legal person wishing to make a purchase via the website of "ACLP", an order addressed by email, or by telephone, hereinafter referred to as "the buyer".
Subject matter
The purpose of these conditions is to define the contractual relationship between ACLP and the buyer, applicable to any purchase made via the merchant site, whether the buyer is professional or private.
The acquisition of a good or service through this site or following an order by email or telephone implies an unqualified acceptance by the buyer of these terms and conditions of sale.
These terms and conditions of sale will prevail over any other general or special terms and conditions not expressly approved by ACLP.
ACLP reserves the right to change its terms of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer.
Characteristics of the goods and services offered
The products and services offered are those contained in the catalogue published on the ACLP website.
These products and services are available within the limits of available stocks.
Each product is accompanied by a description drawn up by the supplier; The buyer may have access to the supplier's documentation.
The photographs in the catalogue are as faithful as possible but cannot ensure a perfect similarity with the product offered, especially in terms of colours or packaging. Generally speaking, photos are not contractual.
Rates
The prices in the catalogue are prices in euro including VAT applicable on the day of the order; any change in the rate may be reflected in the price of the goods or services.
ACLP reserves the right to change its prices at any time, provided that the price in the catalogue on the day of the order will be the only price applicable to the buyer.
The prices indicated do not include the costs of order processing, transport and delivery provided that they take place in the geographical areas set out below.
Geographical area
The online sale of the products and services presented on the site is reserved for buyers residing in France, and more generally in Europe. On request, we can deliver you to Switzerland, to the Dom-Tom, Africa.
Orders
The minimum order is set at 18 € tax excl., or 21,60 € tax incl
The buyer, who wishes to purchase a product or service, must:
– fill in the identification form on which it will indicate all the requested coordinates ;
– complete the online order form by giving all the references of the selected products or services ;
– validate your order after checking it ;
– make the payment under the conditions laid down ;
– confirm its order and payment.
Confirmation of the order results in acceptance of these terms and conditions of sale, recognition of their full knowledge and waiver of their own terms and conditions of purchase or other conditions.
All the data provided and the recorded confirmation will be evidence of the transaction. Confirmation will be valid for signature and acceptance of the operations carried out.
The seller will communicate by e-mail confirmation of the registered order.
Withdrawal
Buyers, who are non-professional natural persons, are entitled to a withdrawal period of fourteen days from the delivery of their order to return the product to the seller for exchange or refund without penalty, with the exception of the return costs, and the forward shipping costs if the original order is fully returned.
No merchandise returns will be accepted 2 weeks after delivery, nor on open or used products.
Payment methods
The price is payable on order.
Payments are possible by credit card, cheque, transfer, paypal, googlepay.
Credit card payments will be made through the Payplug secure system, which uses SSL (Secure Socket Layer) so that the information transmitted is encrypted by software and no third party can learn about it during network transport.
For professionals with whom we have validated payment terms (30 days invoice date in general), the order is shipped as soon as it is confirmed. On the same day, the invoice is sent by email, or paper, or filed on a specific platform. Then it must be settled after the validated payment terms between ACLP and the customer. In case of delay in paying the bill, a graduated restart will be set up between ACLP and the customer.
At the buyer's request, a paper invoice will be sent to the buyer showing VAT.
Delivery
Packages are usually shipped after receipt of payment, the same day for orders validated before 12:00 p.m.
They are shipped with a tracking number. The transport costs are flat, regardless of the total weight of the package. We recommend that you combine all your items into one order.
We cannot group two separate orders and shipping costs apply to each of them. Your parcel is shipped at your own risk, but special attention is paid to fragile objects.
The transport costs are offered from 100 € tax excl. – 120 € tax incl. (Metropolitan France only) ordered goods.
For a delivery in Corsica, only the Colissimo and Letter Max carriers will be applied.
For logistical reasons, ACLP reserves the right to transform a chosen Colissimo carrier into the Chronopost carrier.
The sizes of the boxes are appropriate and your items are properly protected.
Shipments are made at the address indicated in the order form which can only be within the agreed geographical area.
The risk is borne by the purchaser from the moment the products left ACLP's premises. In case of damage during carriage, the reasoned protest must be made to the carrier within three days of delivery.
Delivery times are given only for information purposes; The deadlines that we deliver are never a firm commitment on our part to deliver on a fixed date. If these exceed 30 days from the order, the sales contract may be terminated and the buyer refunded.
Guarantee
All products supplied by the seller enjoy the legal guarantee provided for in articles 1641 et seq. of the Civil Code.
In the event of non-compliance with a product sold, it may be returned to the seller who will take it back, exchange it or refund it.
All claims, exchange or refund requests must be made by mail at SAS ACLP 78 rue Alfred Sisley 76220 Le Havre, or by e-mail or telephone within 30 days of delivery.
Liability
The seller, in the online sales process, is bound only by an obligation of means; its liability cannot be incurred for damage resulting from the use of the Internet such as data loss, intrusion, virus, service breakdown, or other involuntary problems.
Intellectual property
All elements of the ACLP site are and remain the intellectual and exclusive property of ACLP.
No person shall be permitted to reproduce, exploit, rebroadcast or use, in any capacity whatsoever, elements of the site, whether software, visual or audio.
Any simple or hypertext link is strictly prohibited without a written agreement from ACLP.
Personal data
According to the Law on Computer Science, Files and Freedoms of 6 January 1978, information of a nominative nature relating to purchasers may be processed automatically.
ACLP reserves the right to collect information about buyers, including by using cookies, and, if it wishes, to transmit the information collected to trading partners.
Buyers may object to the disclosure of their contact information by reporting it to ACLP. Similarly, users have the right to access and correct data concerning them, in accordance with the Law of 6 January 1978.
Archiving - Evidence
ACLP will archive purchase orders and invoices on a reliable and durable medium constituting a true copy in accordance with article 1348 of the Civil Code.
CALP's computerized records will be considered by the parties as evidence of communications, orders, payments and transactions between the parties.
Dispute resolution
These online sales conditions are subject to French law.
In the event of a dispute, jurisdiction shall be conferred on the competent courts, notwithstanding a plurality of defendants or an appeal for security.
Photo
The photos are not contractual, and do not represent the dimensions of the products, only the product description is contractual.
Conditions of payment:
By credit card, paypal, googlepay: this means of payment is absolutely safe, the information remains confidential and is not accessible to us
By check. You can pay us by cheque, sending us your payment accompanied.
By bank transfer. The transfer instructions will be given to you at the end of the order (the order is validated upon receipt of the transfer).
Shipping costs
For a freight order of less than 100€ tax excl., the amount of the shipping costs varies from 6,00 € tax excl. (relay point) to 10,68 € tax excl. (Chronopost) for France (excluding overseas departments). The shipping costs are offered from 100 € tax excl. commission of goods (shipping fee at 100 € tax excl.).
In case of validation of the partial delivery option:
- if the total hT of goods is < 100€ tax excl., then 2 shipping costs will be charged,
- if the total HT of goods is > 100€ HT, and < 200€ HT, then 1 shipping charge will be charged,
- if the total HT of goods is >= to 200€ HT, then the shipping costs are offered
Manual control processing costs
For a manual order (by e-mail, telephone) of less than 50 € tax excl., a processing fee of 10 € VAT is applied.
